Terms of Service
Welcome to Moodzy. These Terms of Service (the "Terms") are the agreement between you and Moodzy, the app that lets you set a mood, find people and short-lived local events nearby, and actually go meet up — all for free.
We've written this in plain English wherever we can, because you should be able to understand what you're agreeing to without a law degree. The legal substance is still here and it's binding, so please read it. If a particular line is in legal-speak, it's because it matters.
By creating an account or using Moodzy, you agree to these Terms, to our Privacy Policy, and to our Community Guidelines. If you don't agree with them, that's okay — but you shouldn't use the app.
01Agreeing to these terms
These Terms form a legally binding agreement between you and Moodzy ("Moodzy", "we", "us", or "our"), a product operated from Dehradun, Uttarakhand, India.
You accept these Terms when you do any of the following:
- create a Moodzy account,
- sign in with your phone number, or
- otherwise use any part of the app.
If you're using Moodzy on behalf of someone else, or you don't have the authority to agree, please don't use it. These Terms work together with our Privacy Policy, Community Guidelines, and our Child Safety commitments — together they're the full agreement that governs your use of Moodzy.
Use Moodzy, and you're agreeing to these Terms. They're binding. If you don't agree, don't use the app.
02Who can use Moodzy
You must be at least 13 years old to use Moodzy. There are no exceptions to this — it's a hard floor.
If you're under 18, you're a minor under these Terms, and there are extra rules that exist to keep you safe:
- By using Moodzy, you confirm that a parent or legal guardian knows you're using it and has given their consent. Under India's Digital Personal Data Protection (DPDP) Act 2023, processing a child's personal data needs the verifiable consent of a parent or lawful guardian, and we rely on that consent for users under 18.
- We do not run behavioural tracking, behavioural monitoring, or targeted advertising directed at children. We don't run targeted advertising at all.
You also confirm that you're legally allowed to use Moodzy where you live, and that you haven't been previously banned from the app. If we believe you don't meet these requirements, we may suspend or remove your account.
If your child is under 18 and using Moodzy, you can review or request deletion of their data anytime — email privacy@moodzy.club. See our Child Safety page for more.
03Your account, your responsibility
Moodzy uses phone-number sign-in with a one-time code (OTP). There are no passwords, and no Google, Apple, or Facebook logins. It's just your phone number.
A few things that come with that:
- One account per person. Each phone number gets one account. Don't create multiple accounts to get around a block, a ban, or a limit.
- Keep your number and device secure. Anyone with access to your phone and your OTP can get into your account. If you lose your phone or think someone has access, secure it right away.
- Your profile is yours to manage. Your display name, username, bio, avatar, mood, and interests are up to you — within our Community Guidelines.
You're responsible for what happens on your account. If you let someone else use it, what they do counts as your activity under these Terms.
04What Moodzy is (and isn't)
Moodzy is a free, real-time, location-based social and events app. You set a mood or activity, and Moodzy helps you discover other people and short-lived local events happening near you.
Here's how it works at a glance:
- Events are short-lived. They automatically expire after roughly 4 hours and drop off the map. Moodzy is built for what's happening now, not a permanent calendar.
- You can join, create, and chat. Talk in event group chats and in 1:1 direct messages, and share photos and location pins in chat.
- It's completely free. No in-app purchases, no subscriptions, no ads. We don't sell, rent, or trade your personal data, and we don't run behavioural or ad tracking. (See our Privacy Policy for the full picture.)
Moodzy is for platonic, real-world social connection. It is explicitly not a dating app — there's no swiping and no romantic matching. Using Moodzy to solicit dates, romantic, or sexual connection isn't what it's for and isn't allowed.
Because Moodzy is free and we keep improving it, features may change, launch, or be retired over time. We'll try not to break things you rely on, but we can't promise the service will always look or work exactly as it does today.
05How to behave here
Moodzy only works if people treat each other decently. By using the app, you agree to follow our Community Guidelines, which are part of these Terms.
The short version: be a real person, be respectful, and don't make the space worse for everyone else. Harassment, hate, threats, spam, scams, sexual content, and anything that endangers a minor are not welcome here and will get you removed.
If you see something that breaks the rules, use Report and Block — they're available from profiles, chats, and events. Reports go to a real review process, and we keep moderation logs.
The full list of what's allowed and what isn't lives in our Community Guidelines. Breaking them can lead to content removal, suspension, or a ban.
06The content you create
On Moodzy, you'll create things — events, group and direct messages, photos you share in chat, and location pins. We call all of that your content.
You own it
Your content is yours. These Terms don't take any ownership of it away from you.
You give us a limited licence to run the app
To actually operate Moodzy, we need permission to do technical things with your content — store it, transmit it, and show it to the people it's meant for. So you grant Moodzy a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display your content solely to operate, provide, and improve the service. For example, displaying your event to people nearby, or delivering your message to the person you sent it to.
This licence exists only so the app can function. We don't use it to sell your content or to advertise. When you delete your content or your account, this licence ends for that content, except for copies we're required to keep by law or that are needed for safety and abuse records, and except where content has already been shared with others.
You're responsible for what you post
You promise that the content you share is yours to share and doesn't break the law or these Terms. You're responsible for it. We're not obligated to monitor everything, but we can remove content that violates these Terms or our Community Guidelines.
07Safety & meeting people in person
This is the most important section in these Terms, so please read it carefully.
Moodzy helps you discover people and events nearby, and we've built real safety features to protect you:
- The location shown to others is approximate only — it's randomized with roughly a 100–300 metre offset, so your exact coordinates are never shared.
- Your phone number is never shown to other users.
- Ghost Mode lets you browse invisibly.
- Report and Block are available everywhere, backed by reviewed moderation and profanity and image filters.
But here's the honest part: meeting people you met online carries real risk, and no app can remove that risk. A profile can't tell you everything about a person.
Meet in a public place. Tell a friend or family member where you're going and who you're meeting. Trust your instincts — if something feels off, leave. Don't share your home address, financial details, or sensitive personal information.
Moodzy is a neutral platform and intermediary. We help people find each other; we are not a party to, do not arrange, and are not responsible for any in-person meetup, conversation, or interaction between users. Any meetup or interaction is entirely at your own risk and between you and the other people involved. To the fullest extent the law allows, Moodzy is not liable for the conduct of any user, whether online or in person, or for anything that happens at or because of a meetup.
08Things you can't do
To keep Moodzy safe and working, you agree not to:
- use Moodzy if you're under 13, or under 18 without parent/guardian consent;
- impersonate someone else, or create a fake or misleading identity;
- harass, threaten, stalk, bully, or intimidate anyone;
- post or share sexual content, hate speech, violent content, or anything that endangers a child — see our Child Safety policy;
- use Moodzy for dating, romantic, or sexual solicitation;
- spam, scam, advertise, or run commercial schemes;
- create multiple accounts, or evade a block or ban;
- collect or scrape other users' data, including their locations;
- try to find or reveal another user's exact location, phone number, or other private information;
- break, overload, reverse-engineer, or interfere with the app, its security, or its infrastructure;
- use bots, automation, or scripts to access or interact with the service; or
- do anything illegal, or that violates these Terms or our Community Guidelines.
09Reporting, suspension & termination
If content or behaviour breaks these Terms or our Community Guidelines, we can act on it. Depending on what happened, we may:
- remove or hide the content,
- limit or suspend an account, or
- permanently ban an account.
For serious or repeated violations — and especially anything involving the safety of a child — we may ban an account immediately and, where appropriate, report it to the relevant authorities. We keep moderation logs to support fair and consistent decisions.
You can leave anytime. You can delete your account in-app at Settings > Account > Delete account, or, if you can't access the app, by emailing support@moodzy.club or using moodzy.club/delete. Deletion is permanent and removes your account and its data, subject to limited retention required by law or for abuse and safety records — details are in our Privacy Policy.
10Moodzy's brand and rights
Everything that makes up Moodzy itself — the app, its software, design, logos, the name "Moodzy", and other brand features — belongs to Moodzy and its licensors, and is protected by intellectual property laws. (Your own content stays yours, as covered above.)
You're welcome to use Moodzy as intended. But you may not copy, modify, distribute, sell, or create derivative works from the app or its brand, or remove any of our branding or notices, without our written permission.
11Third-party services we rely on
To make Moodzy work, we use a few trusted service providers under contract. We never sell your data to them — they only process what they need to provide their part of the service:
- Mapbox — maps and geocoding.
- Google Firebase Cloud Messaging — push notifications.
- Our cloud and server hosting provider — running the app.
- A CAPTCHA / anti-abuse provider — keeping bots and abuse out.
These providers have their own terms and privacy practices. When you use map features or receive notifications, those parts of the experience are partly powered by these third parties, and we're not responsible for their services. Our Privacy Policy explains what's shared and why.
12Disclaimers — the app is provided "as is"
We work hard to keep Moodzy reliable, safe, and useful. But we have to be honest: no app is perfect, and we can't promise it'll always be available, error-free, or exactly what you hoped.
To the fullest extent permitted by law, Moodzy is provided "as is" and "as available", without warranties of any kind, whether express or implied — including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In particular, we don't warrant that:
- the service will be uninterrupted, secure, or error-free;
- any defects will be fixed;
- the people, events, or content you find on Moodzy are accurate, genuine, safe, or trustworthy; or
- any meetup or interaction will be safe or turn out the way you expect.
You use Moodzy at your own discretion and risk.
13Limitation of liability
Moodzy is a free service, and there are limits to what we can be responsible for. To the fullest extent permitted by law:
- Moodzy and its team won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or other intangible losses.
- We won't be liable for the conduct of any user, for any in-person meetup or interaction, or for content posted by others.
- Where liability can't be excluded by law, our total liability to you for any claim relating to Moodzy is limited to the amount you paid us to use the service — which, because Moodzy is free, is zero.
Some places don't allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that legally can't be limited.
14Covering us if something goes wrong
If your use of Moodzy, your content, or your breach of these Terms causes a claim, loss, or legal action against us, you agree to indemnify and hold harmless Moodzy and its team from any resulting claims, damages, losses, liabilities, and reasonable legal costs.
This means that if someone takes legal action against us because of something you did on Moodzy, you're responsible for it — not us. We may take over the defence of any such claim, and you agree to cooperate with us if we do.
15Governing law & disputes
These Terms are governed by the laws of India, including the Digital Personal Data Protection (DPDP) Act 2023 and the DPDP Rules 2025, the Information Technology Act 2000 and the Intermediary Guidelines (IT Rules) 2021, and the POCSO Act for child safety.
Any dispute relating to Moodzy or these Terms is subject to the exclusive jurisdiction of the courts of Dehradun, Uttarakhand, India.
If you're outside India, you're still afforded equivalent GDPR / CCPA-style rights where they apply to you, and local consumer-protection laws may give you additional rights that these Terms don't take away.
Grievance Officer
In line with India's IT Rules 2021 and the DPDP Act, you can raise complaints with our Grievance Officer. We acknowledge complaints within 24 hours and aim to resolve them within 15 days. Contact details are below and on our Grievance page.
16Changes to these terms
Moodzy will keep growing, and these Terms may need to change with it. When we make meaningful changes, we'll update the "last updated" date and, where the change is significant, give you a heads-up in the app.
If you keep using Moodzy after an update takes effect, that means you accept the updated Terms. If you don't agree with a change, you can stop using the app and delete your account at any time.
